2. Rights to the content of the offering and its use
All content such as articles, pictures or other information published on the website, as well as the website itself shall be protected by commercial protective rights (for example copyrights, trademark rights) or other rights for Treemedia or third parties.
According to the principles of the private copy permitted by law, according to § 53 of the German copyright act (UrhG), the user shall be allowed to make individual copies of the content available on the website for private purposes, and to download it and print it out, in particular. According to § 51 UrhG, the user shall furthermore be entitled to quote the provided content to the extent permitted.
Any use of the content for commercial purposes shall be prohibited, as far as Treemedia did not agree in a given case in writing. Rights of reproduction and rights of use have to be agreed with Treemedia in separate contracts.

The user shall dispense Treemedia from possible demands of third parties they claim of Treemedia due to the violation of their rights by this user. This shall include, in particular, but not completely, also the costs of an appropriate prosecution and legal defence.

Treemedia shall exclude any liability due to technical or any other malfunctions.
Treemedia, its representatives or vicarious agents shall only be liable for damages due to delay, non-performance or misperformance, or tortious act as long as they are based on the violation of basic contractual obligations (cardinal duties). This exclusion of liability shall neither apply in the case of intent or gross negligence, nor in the case of damage to life, body or health.
A liability for indirect and unforeseeable damages, loss of profits, lost savings, financial losses and claims of third parties shall be excluded in the case of ordinary negligence or force majeure.
